UPDATE Wednesday, April 28, 2010 at 1:55 PM:

I (Rinaldo Del Gallo) have spoken to Richard Rodriguez Senior this morning and he has indicated that:

1. He has obtained Richard Rodriguez Junior and the child is in relatively good spirits and they are en route to Pittsfield.

2. There was a media frenzy in Kansas and he does not want to have the child subjected to cameras and reporters upon arrival in Pittsfield.

3. He should be arriving in Pittsfield tonight.

4. He asks that he be left alone for a while by the media. (If there is a change in this position, I will send out another e-mail.)

I have spoke to Jennifer Smith who has indicated:

5. Jennifer Smith, wife of William Smith (William Smith is Richard Rodriquez's foster brother), sent out fliers to EVERY ELEMENTARY SCHOOL IN KANSAS immediately after Richard Rodriguez was placed on the Missing Person list. This directly resulted in Richard Junior being found. She deserves a pat on the back and media recognition.

I am pleased to announce that a missing child, Richard Rodriquez, Junior has been found. As this e-mail is being written, the child's father, Richard Rodriquez, Senior is getting to an airplane to pick up his son in Emporia, Kansas.

The child is currently in the custody of state officials until the father is able to pick up the child and return him to Massachusetts. Attorney Rinaldo Del Gallo has sent via over-night delivery a certified copy of a final judgment of the child, a judgment that issued November 9, 2009. The certified judgment was sent to Brenda Fisher, a Community Corrections Officer in Emporia, Kansas 66801. 620-343-5503.

Richard Rodriquez Jr., who was born February 6, 2002 in Pittsfield (now age 8), was taken Super Bowl Sunday, February 4, 2008-2 days before his 6th birthday. The child has been missing for two years and two months.

Notes Attorney Del Gallo, "It is against the law in Massachusetts for a child who is a native of Massachusetts or who has resided her for five years to be removed from the state without the other parent's consent and without court order. This law protects children born in-wedlock and out-of-wedlock. The initial removal of the child was completely without lawful authority."
